NHTSA Investigates Tesla’s Cybercab for Compliance with Vehicle Safety Standards

The National Highway Traffic Safety Administration (NHTSA) has started an investigation into Tesla’s recent deployment of its Cybercab in Austin, Texas. The Cybercab operates without a steering wheel or pedals, features that current federal regulations typically require for vehicles on public roads. Tesla informed NHTSA that it self-certified the Cybercab as compliant with all applicable Federal Motor Vehicle Safety Standards (FMVSS). NHTSA’s investigation aims to review the technical data and certification process Tesla used, particularly focusing on whether certain federal standards were deemed inapplicable to the Cybercab. This inquiry follows a similar path taken with Amazon-owned autonomous vehicle company Zoox, which also self-certified a robotaxi lacking traditional controls. Zoox faced regulatory scrutiny that delayed its commercial launch but eventually received a temporary exemption to operate a limited fleet. The outcome of Tesla’s investigation remains uncertain, but it highlights ongoing regulatory challenges as automakers develop vehicles designed for autonomous operation without manual controls. The Department of Transportation has proposed removing some manual control requirements for autonomous vehicles, but the transition is still under close federal review.
